PLEASE READ THESE NEW YOU BEAUTY & AWARDS LIVE TERMS AND CONDITIONS CAREFULLY BEFORE SUBMITTING AN ENTRY TO THE AWARDS. IF YOU DO NOT AGREE TO THESE TERMS AND CONDITIONS, YOU MUST NOT SUBMIT ANY ENTRIES TO THE AWARDS.
The NEW YOU Beauty & Awards Live (the “Awards”) are owned and organized by New You Brands, Inc. and/or one or more of its affiliate companies (collectively, “Sponsor”, “we,” “us,” or “our”). These Awards Terms and Conditions govern your submission of entries for consideration (each, an “Entry” and together, the “Entries”) into the Awards. By submitting an Entry, you agree to these Awards Terms and Conditions, the NEW YOU Terms & Conditions, Privacy Policy, and other policies posted on www.newyouawards.com which are incorporated herein by reference.
1. Making an Entry
1.1. Entries must be made following the process set forth on the NEW YOU Beauty & Awards Live Entry Form.
1.2. Sponsor shall not be responsible for Entries that are lost, misplaced, or damaged, regardless of cause, including, for example, as a result of any postal failure, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind. For the avoidance of doubt, proof of posting or transmission of a lost or delayed Entry for the Awards will not be accepted as a valid or alternative Entry.
1.3. You agree that Sponsor may use, and you grant to us a non-exclusive, perpetual, worldwide, irrevocable, royalty-free, fully sublicensable and assignable license in and to, your name and likeness and/or that of your company, brand, product, and related company, brand, and product logos for advertising, publicity or informational purposes in connection with these Awards and future New You Beauty & Awards Live events in any and all digital, print, and other form and media now known or hereafter devised.
2. Entry Fees
2.1. Each submission of an Entry is subject to an Entry fee (each, an “Entry Fee”). The Entry Fee must be paid upon submission of each Entry using the New You Beauty & Awards Live Entry Form. Failure to pay the Entry Fee shall constitute a Non-Compliant Entry (as such term is hereinafter defined). For the avoidance of doubt, the Entry Fee is solely to be considered for an award and does not include admission to the Awards.
2.2. All Entry Fee payments, and any information you submit in connection with paying the Entry Fee, shall be processed by Wix.com, Ltd. (“Wix”) and shall be subject to Wix’s Terms of Service and Privacy Policy, which may be updated from time to time in Wix’s sole discretion. Payments made by credit card may be subject to an additional processing fee.
2.3. Entry Fees are non-refundable. Withdrawn Entries (whether withdrawn by you, or disqualified by Sponsor, due to a Non-Compliant Entry) will not be refunded. Sponsor may choose, at Sponsor’s sole discretion, to issue refunds in limited circumstances and on a case-by-case basis. If a refund is issued, it will be processed to the original method of payment. Sponsor cannot issue a refund to a different credit or debit card. If your credit card or debit card number has changed, but is for the same account (e.g., a new card has been issued for the same account), the refund will be processed to that account.
3. Eligibility and Judging
3.1. The Awards are open to those fulfilling the Entry criteria set forth on the New You Beauty & Awards Live Entry Form.
3.2. You must not submit an Entry that you know or suspect:
a) is inaccurate, false, or misleading (including where it omits material information regarding the subject of the Entry); or
b) contains information or material that: (i) infringes the intellectual property rights of any third party; (ii) the disclosure of which would place you in breach of confidentiality obligations owed by you to any third party; or (iii) is or may be defamatory.
(any such Entry is a “Non-Compliant Entry”).
3.3. You warrant that: (i) you have all relevant rights and licenses in place to permit Sponsor’s publication and use of any supporting documentation and materials provided in connection with your Entry (“Entry Materials”); and (ii) Sponsor’s publication and use of your Entry Materials will not infringe the intellectual property rights of any third party.
3.4. Sponsor reserves the right to disqualify any Entry that we consider, in Sponsor’s sole discretion, to be a Non-Compliant Entry.
3.5. Entries will be judged by Sponsor at Sponsor’s sole discretion and based on criteria established by Sponsor in Sponsor’s sole discretion. Sponsor’s decision shall be final, and Sponsor shall have no obligation to enter into any correspondence or discussions with anyone, nor will Sponsor accept any submissions, representations or appeals, with regard to such decision.
3.6. Sponsor reserves the right to not make any particular award in any given category.
3.7. Your Entry and Entry Materials will not be considered to be confidential information.
3.8. Submission of an Entry does not guarantee that your Entry will be featured, referenced, or represented at the Awards or used by Sponsor in any other way (including in any advertising, publicity or information materials).
4. Winners, Finalists, and Nominees
4.1. Award finalists will be notified on or about January 2027 to allow time to prepare for attending the Awards ceremony; provided, however, that Sponsor reserves the right to adjust this timeline as necessary.
4.2. If Sponsor so elects, Award finalists may be required to submit to a confidential background check. Such background check may include (but is not limited to) investigation of criminal, sexual offenses, or other arrest or conviction record, and any other factor deemed relevant by the Sponsor to help ensure that the winner will not bring the Sponsor into public disrepute, contempt, scandal, or ridicule or reflect unfavorably on Sponsor. If requested, the Award finalist agrees to sign waiver forms authorizing the release of personal and background information. In the event of noncompliance, to be determined at the sole discretion of Sponsor, prize will be forfeited, and an alternate award finalist will be selected. Subject to verification of eligibility and compliance with the terms of these Awards Terms and Conditions, the chosen award finalist will be declared the official winner (the “Winner”) of the corresponding award.
4.3. Winners will be announced publicly at the Awards ceremony, which is presently scheduled to take place on March 20, 2027 at the Eden Roc hotel in Miami Beach, Florida, although the date, time, and location may be subject to change. Additionally, Sponsor may announce Winners online on www.newyouawards.com, www.newyou.com (or any of Sponsor’s other websites), and our related social media accounts.
4.4. Winners shall receive a “New You Beauty & Awards Live” seal (the “Seal”), which may be used by Winners on the winning product’s packaging, ads, web, and social media platforms (“Winner Materials”) subject to Sponsor’s style and branding guidelines for the use of the Seal; provided, however, that any winner must remove the Seal from all Winner Materials promptly upon Sponsor’s request.
4.5. One (1) beauty brand or beauty product that has demonstrated exceptional innovation, originality and potential shall be awarded the “NEWy Award”. The Winner of the “NEWy Award” shall receive a check in the amount of USD $5,000.00 in addition to receiving the Seal and related rights to the use of the Seal. To be eligible for the “NEWy Award” you must have launched the corresponding product or brand within eighteen (18) months prior to submission of the corresponding Entry. Winner is solely responsible for all taxes associated with prize acceptance and receipt.
4.6. If you win a New You Beauty & Awards Live Award, and you choose to use the Seal, you agree to follow such style and branding guidelines and to promptly remove such seal from your Winner Materials if so requested.
5. Attendance at the Awards
5.1. You acknowledge and understand that your Entry does not constitute a booking or invitation to attend the Awards.
5.2. The opportunity to attend the Awards shall require a separate invitation from Sponsor and may require the purchase of separate event tickets to be admitted for entry.
6. Release. By accepting an Award, each corresponding Winner agrees to release and hold Sponsor and its affiliated entities, officers, and employees (collectively, the “Released Parties”), harmless from all losses, damages, rights, claims and actions of any kind resulting from acceptance of the Award and related use of the Seal. IN NO EVENT WILL THE RELEASED PARTIES AND/OR THEIR PARENTS, AFFILIATES, SUBSIDIARIES AND RELATED COMPANIES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS, BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING, BUT NOT LIMITED TO, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR PARTICIPATION IN THE AWARDS. WITHOUT LIMITING THE FOREGOING, EVERYTHING ON THE WEBSITE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT.
7. Dispute Resolution and Waiver of Trial by Jury. IT IS MUTUALLY AGREED BY AND BETWEEN YOU AND SPONSOR THAT ANY CLAIM THAT YOU MAY HAVE IN THE FUTURE MUST BE RESOLVED IN ACCORDANCE WITH SPONSOR’S TERMS AND CONDITIONS POSTED ON WWW.NEWYOUAWARDS.COM.
8. Choice Of Law and Forum. You agree that all matters arising out of or relating to the Awards are governed by, and construed in accordance with, the laws of the State of Florida, without giving effect to any of its conflict of law provisions thereof. You further agree that any legal suit, action, or proceeding arising out of or relating to the Awards that is excluded from the dispute resolution procedure and class action waiver provisions set forth herein shall be brought exclusively in the courts located in Broward County, Florida.
